With an estimated 7% of mortgaged property in foreclosure, 40% of which involve so called ‘sub-prime’ mortgages, many states are beginning to consider legislation that could open the door to opportunities mediating foreclosure matters. In Connecticut, for instance, during the four month period at the end of last year 70% of cases avoided foreclosure following completion of mediation.
 
A recent ACR release reports that:
 
Legislation tied to mortgage foreclosure mediation has been passed in New York, New Jersey, and Connecticut, in addition to counties in Ohio, Florida, and the city of Philadelphia. Similar legislation is being proposed in counties all over the country including Indiana, Maine and Nevada and there is even a federal bill that would incorporate mediation in its attempts to lower the escalating foreclosure rates. ...Some of the programs, such as the very successful Philadelphia Homeowner Diversion Program include mandatory mediation prior to foreclosure litigation, which has led to 78% of homeowners in Philadelphia who had entered the mediation program in 2008 remaining in their homes with little direct cost beyond outreach and administration of the jurisdiction that implements the mediation.
 
A panel of representatives from various New England states will discuss the status of foreclosure legislation and programs around New England, including an upcoming legislative hearing in Massachusetts. This timely program will also focus on opportunities as well as challenges in the important field of foreclosure mediation.
 
The panel will include: Charlie Pillsbury, Executive Director, Community Mediation, Inc. New Haven, CT; Abigail Jones- Herriott, Executive Director, Community Mediation Center of RI; Richard Tillberg, a mediator from Western Massachusetts and program moderator Sharon Tracy, founder and executive director of Quabbin Mediation in Orange, Massachusetts.
