Drafting Memoranda of Understanding or Separation Agreements/MWI

As parties reach agreements, the focus of the mediation will shift to memorializing them in writing. For capturing interim and/or conditional agreements, an email may be appropriate. Once a critical mass of agreements is reached, the mediator will prepare either a memoranda of understanding or a separation agreement. Michael Leshin and Laura Gibbs of Ginsburg Leshin Gibbs & Jones, LLP will review the Boston Bar Association and Massachusetts Bar Association opinions which address the scope of a lawyer/mediator’s role in drafting a separation agreement. We will review how memoranda of understanding can best provide a foundation for the ultimate drafting of a Separation Agreement. In addition, we will discuss the ever present “rearview” mirror of a future contempt and/or modification as a tool in preparing cogent agreements.
